2. General conditions for use of the site and the services proposed.

Use of the site implies full and unreserved acceptance of the general conditions of use set out below. Those conditions of use may be modified or supplemented at any moment; users of the site are therefore invited to consult them regularly.

The site is normally accessible to users at all times. Aquafit Technologie, a SIREM group trademark, may however decide to interrupt service for technical maintenance reasons and will make every effort to advise users in advance of the dates and times of such interruptions.

3. Description of the services supplied.

The aim of the site is to provide information on all the company’s activities.

Aquafit Technologie, a SIREM group trademark, endeavours to supply the site with information that is as accurate as possible. However, it cannot be held liable for omissions, inaccuracies and deficiencies in updates, whether due to its own actions or those of third party partners who provide the information.

All information published on the site is given for guidance purposes only and is subject to change. Furthermore, information appearing on the site is not necessarily complete. It is provided subject to modifications that may have been made since it was put on line.

4. Contractual limitations on technical data.

The web site cannot be held responsible for damage to hardware linked to use of the site. Furthermore, site users undertake to use recent hardware that is free from viruses and an up-to-date, latest generation navigator.

5. Intellectual property and fraud.

Aquafit Technologie, a SIREM group trademark, is the owner of the intellectual property rights or holds the right to use all the elements present on the site, in particular, texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication or adaptation of all or part of the site’s components, whatever the means or process used, is prohibited, unless previously authorised in writing by: Aquafit Technologie, a SIREM group trademark.

Any unauthorised operation of the site or any of the elements contained in it will be considered as constituting a fraud and pursued in law under the provisions of articles L.335-2 et seq. of the Intellectual Property Code.

6. Limitations to liability.

7. Management of personal data.

In France, personal data are protected, in particular by law no. 78-87 of 6 January 1978, law no. 2004-801 of 6 August 2004, article L. 226-13 of the Penal Code and the European Directive dated 24 October 1995.

On the occasion of use of the site, the URL for the links by means of which the user has accessed the site, the user’s supplier providing access and the user’s internet protocol (IP) address may be collected.

In any event, Aquafit Technologie, a SIREM group trademark, only collects personal information about the user for the needs of certain services offered on the site. Users are fully aware that they are providing this information, particularly when they enter it themselves. Users of the site are then informed whether or not there is an obligation to supply that information.

8. Hypertext links and cookies.

The site contains a certain number of hypertext links to other sites, inserted with the permission of Aquafit Technologie, a SIREM group trademark. 9. Applicable law and attribution of jurisdiction.

Any dispute relating to use of the site is subject to French law. Jurisdiction is attributed exclusively to competent courts in Paris.
